Nature of the Service

The Service provides time-based access to vehicle-related information for informational purposes only. The Service does not sell individual vehicle reports and does not guarantee the accuracy, completeness, or availability of any specific data.

Subscription & Billing

The Service operates on a subscription-based, time-access model. Users are charged for temporary access during defined billing periods, not per individual report.

A trial activation fee of $3 grants initial access to the Service. After 10 days, a charge of $49 is applied for the next access period. This charge may repeat every 10 days for a maximum of three (3) billing cycles. After the final billing cycle, the subscription is automatically canceled.

Billing is aggregated and applied once per billing period. Charges are not based on daily usage or per-report consumption.

Usage Limits

Access to the Service is subject to daily usage limits, including a maximum of two (2) reports per day. Daily limits apply regardless of actual usage.

Cancellation & Refunds

Users may cancel the subscription at any time. Cancellation prevents future charges but does not retroactively refund processed payments.

All charges are non-refundable except where required by law. Unused access time or unused report capacity does not constitute grounds for refunds.

Permitted Use

Vehicle reports are provided through ClearVin and are for personal or internal informational use only. By accessing any vehicle report, you expressly agree that:

Disclaimer and Waiver

Reports are provided "as is" and "as available" without warranties of any kind, either express or implied. You use the reports at your own risk.

YOU EXPRESSLY WAIVE ANY AND ALL CLAIMS AGAINST CLEARVIN arising from or related to the vehicle reports, including but not limited to claims based on inaccuracy, incompleteness, errors, omissions, or reliance on report data. ClearVin shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the reports.

You agree to indemnify, defend, and hold harmless ClearVin, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

NMVTIS Disclaimer

Important: The National Motor Vehicle Title Information System (NMVTIS) is an electronic system that contains information on certain automobiles titled in the United States. NMVTIS is intended to serve as a reliable source of title and brand history for automobiles, but it does not contain detailed information regarding a vehicle's repair history.

All states, insurance companies, and junk and salvage yards are required by federal law to regularly report information to NMVTIS. However, NMVTIS does not contain information on all motor vehicles in the United States because some states are not yet providing their vehicle data to the system. Currently, the data provided to NMVTIS by states is provided in a variety of time frames; while some states report and update NMVTIS data in "real-time" (as title transactions occur), other states send updates less frequently, such as once every 24 hours or within a period of days.

Information on previous, significant vehicle damage may not be included in the system if the vehicle was never determined by an insurance company (or other appropriate entity) to be a "total loss" or branded by a state titling agency. Conversely, an insurance company may be required to report a "total loss" even if the vehicle's titling-state has not determined the vehicle to be "salvage" or "junk."

A vehicle history report is NOT a substitute for an independent vehicle inspection. Before making a decision to purchase a vehicle, consumers are strongly encouraged to also obtain an independent vehicle inspection to ensure the vehicle does not have hidden damage. The Approved NMVTIS Data Providers (look for the NMVTIS logo) can include vehicle condition data from sources other than NMVTIS.

Consumers are advised: If you are buying a vehicle, get as much information as you can. Compare the information in the NMVTIS vehicle history report to the vehicle title, and have the vehicle inspected by a trusted mechanic. To learn more, visit vehiclehistory.bja.ojp.gov.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind.

Limitation of Liability

In no event shall the Company be liable for any indirect, incidental, or consequential damages arising from use of the Service.

Indemnification

You agree to indemnify and hold the Company harmless from any claims arising from misuse of the Service.

Governing Law

These Terms are governed by the laws of the United States and the State of California.

Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
